The Federally Supported Health Centers Assistance Act

The Federally Supported Health Centers Assistance Act of 1992 and 1995 granted medical malpractice liability protection through the Federal Tort Claims Act (FTCA) to HRSA-supported health centers. Under the Act, health centers are considered federal employees and are immune from lawsuits, with the Federal government acting as their primary insurer.

The Health Resources and Services Administration (HRSA), in accordance with the Federally Supported Health Centers Assistance Act (FSHCAA), as amended, sections 224(g)-(n) of the Public Health Service (PHS) Act, 42 U.S.C. §§ 233(g)-(n), deems First Choice Community Health Centers to be an employee of the PHS, for the purposes of section 224, effective 1/1/2024 through 12/31/2024. This Deeming Action is also a confirmation of medical malpractice coverage for both First Choice Community Health Centers and its covered individuals.
